في مايو 2018 ألقت السلطات الأمنية القبض على فتحي بعد قيامها بنشر شريط فيديو على موقع فيسبوك تنتقد فيه المؤسسات المصرية والتحرش الجنسي، ما أثار جدلا على وسائل التواصل الاجتماعي و كانت قد سجلت هذا الفيديو بعد ما تعرضت للتحرش من احد موظفي احدي البنوك وبالرغم من انها كانت ضحية التحرش الا ان السلطات الامنية قبضت عليها ظلما كعادتهم و تعرضت امل للكثير من الظلم و الانتهاكات من قبل السلطات الامنية و تم الصاق تهم لها
وظلت امل معتقلة و في سبتمبر الماضي حكمت محكمة جنح المعادي (في جنوب القاهرة) على أمل فتحي بالحبس عامين وغرامة عشرة آلاف جنيه (560 دولارا) وكفالة بقيمة عشرين ألف جنيه (1123 دولارا) لإيقاف تنفيذ العقوبة، ورغم سداد الكفالة إلا أنها ظلت محبوسة احتياطيا في قضية أخرى تم تلفيقها لها وظلت محبوسة حتي 18-12-2018
.حيث أصدرت محكمة جنايات القاهرة يوم الثلاثاء قرارا بإخلاء سبيل الناشطة أمل فتحي بالتزامن مع حصول زوجها الناشط محمد لطفي على جائزة حقوق الإنسان الفرنسية – الألمانية
الا انه كان افراجا مشروطا حيث المحكمة قضت بالتدابير الاحترازية ممايجعلها تذهب لقسم الشرطة لعمل مراقبة لها و ايضا قضت المحكمة بان تلزم امل البيت و لا يسمح لها بالخروج اي ان المحكمة اكملت الظلم الواقع عليها و انه ليس بافراج بل مهانة لها و لم يكتفي هذا النظام قمعي بهذا القمع بل كانت الصدمة الكبري حينما حكمت محكمة جنح مستأنف المعادي بحبس الناشطة وعضو حركة 6 أبريل “أمل فتحي” لمدة عامين مع النفاذ
وذلك في الدعوى رقم 7991 لسنة 2018، التي تواجه فيها اتهامات بإذاعة أخبار كاذبة ونشر فيديو خادش للحياء العام حيث جاء هذا الحكم الصادم بعد اخلاء سبيلها ب 3 ايام و كأن هذا النظام يستمتع بالانتقام من كل من يعارضه امل فتحي احدي ضحايا هذا النظام القمعي
